Thank you for choosing E-Bike Rental. This document provides you with information on rental services offered by E-Bike Rental in order to help you fully enjoy the entire rental of your equipment. The information included here includes E-Bike Rental conditions and may be subject to change. This information is the attachment of the Sweep Contract and will be attached to the rental agreement you will receive when you take over the equipment. This document provides important information about booking, E-Bike Rental services, and your apprenticeship, including what documents you have when you take over the equipment and your responsibilities.
It is important for E-Bike Rental that you enjoy your special experience of worship and have all the necessary information.

1. General information
In order to use the equipment rented by you for the best conditions, we bring you the following information regarding the services offered by E-Bike Rental.
The rented equipment is in accordance with the terms and conditions of the Rental Agreement. Please carefully read these Terms and Conditions (hereinafter referred to as the "Terms of Rental"), which you acknowledge that you have become aware of and will endeavor to comply with them by signing the Rental Agreement.

a) E-Bike Rental offers rental of electric bikes, electric kick-scooters and accessories, and other related services such as guides, routes information, tours, etc. (hereinafter referred to as "Services"). In view of your use of the services provided, we require that you accept all terms and conditions of this Rental Agreement. You agree and acknowledge that you rent the equipment (equipment) and that the property(s) remain Ours (E-Bike Rental SRL) at any time. A valid or cash credit card is required to pay for the services. The equipment can be rented and used by individuals aged 18 or over. If as a customer you provide false information about your age, you and your legal guardian accept the full responsibility for all claims (as defined below) related to such a misstatement.

b) Changes in Rental Terms. We reserve the right to unilaterally modify these Rental Terms at any time and from time to time, at our sole discretion, without your consent. Whenever a Modification of these Rental Conditions is made, we will post a notice of such of Changes on our site.

2. Proprietary Rights in Website Content; Limited License to Access and Use Website. 
All of the content from the Website or that is available on the Website, including designs, graphics, pictures, video, text, information, applications, and any other files (called further "Website Content"), is the property of E-Bike Rental exclusively and its Related Parties, with all rights reserved by E-Bike Rental and its Related Parties. No Website Content can be modified, distributed, framed, copied, reproduced, republished, displayed, downloaded, posted, or sold by any means or in any form, in part or whole, without E-Bike Rental prior written consent. You agree not to upload or to republish any content found on this website on any other site and you agree not add any of the related information into any other database; further, any other usage of this website is forbidden. You are aware that we may take any legal action in connection with violation of this Agreement. Any use of the website or its content, without our written consent, is strictly prohibited.

3. Creating a reservation
A reservation allows you to choose the specific equipment (electric bicycle, electric kick scooter), various accessories and possibly other services offered by E-Bike Rental, taking over at a specific location, date and time and the desired rental period.
In order to benefit from the services provided by E-Bike Rental, you need to sign a rental agreement and agree to the terms and conditions of E-Bike Rental.
Reservation is not a rental contract. You will sign the Contract when you will taken over the equipment

4. Reservations types: "pay now" or "pay at location"
In the case of online booking, you can choose ether "pay at location" or "pay now" reservation. Not all services can be paid in advance.
Services that can’t be paid in advance, whether or not they can be booked online, will be referred to as "pay at location" services and the conditions specific to this type of payment will apply.

ATTENTION! If you cancel your reservation at least 72 hours before the date of booking, you will receive full refund of the amount paid. You must pay a cancellation fee if cancellation is made less than 71 hours before the booking date, representing the full price of your booking. For more details, please read the "Cancellations" section.
By accepting the booking terms, you allow us to debit your payment from your credit or debit card and keep the amount of the cancellation or non-payment tax, if applicable. This will be done when you book online and you will press the "Pay Now" button.
For "pay at location" situations, you can book the equipment by sending us a reservation request directly from our website, by phone or email and pay for it at the agreed location for pickup, in cash or credit card. When sending a reservation directly from our website we will come back with a response regarding the availability of the booked equipment.

5. Modification of reservation
You can modify the reservation at least 24 hours before the day you have to pick up the equipment by calling us or by email to the contact details displayed on our website. All requested changes are dependent on the availability of the equipment at the new date / time requested and may result in a change in the price available. If the amount resulting from the change is higher than the amount previously paid, you must pay the price difference; and if the amount is lower, we will not give you any reimbursement of the difference, but instead you can purchase the extra services at the takeover of the charge to cover the cost of the resulting difference.
If you initially made a reservation for a specific model of equipment and changed the dating period to a new one, you may not be able to receive the same equipment, but we will try to provide you with similar features.

6. Cancellations of reservation
You may request cancellation of the service at any time before the day you have to pick up the equipment by contacting us by phone or email.
E-Bike Rental may terminate / cancel at any time and unilaterally the right to use our services at our sole discretion and without any notice or cause, especially when the client violates the terms and conditions of service.
Depending on the date of cancellation, you may be charged a cancellation or non-attendance fee.

If you fit in the terms described before and you can receive a refund, please contact us to request a refund. The refund will be made within 14 days or until the provider of your card can process the refund. We do not take responsibility for the duration of the refund operated by the company that administers your card.

7. Prices
Equipment rental rates are calculated based on a number of items such as the rental period, the type of equipment, location, accessories, etc.
ATENTION! If you use the "pay now" method, the fee representing the warranty will be requested at the time of picking up the equipment, either cash or by blocking the amount on your credit card.

8. Specific requirements for equipment rental
Age. The minimum age for renting the equipment is 18 years.
Evidence of Identity. The person who rents the equipment must have proof of his or her real identity eg. a valid passport or a valid identity document. The photo document must be identifiable. A copy of the document presented or a photograph will be made which will be destroyed when the equipment is returned under the conditions specified in the contract and in good working order without damage. When making your booking, you agree to E-Bike Rental staff's verification of your own, for more details on personal data processing, please read the section.
Payment method. We accept payment in cash or card, online and on site.
The name entered on the payment card made either by the "pay now" method or the "pay at location " method must be the same as the name entered on the identity card presented at the takeover of the equipment. If you do not have the payment card used to make the reservation, we have the right to cancel the reservation with the full amount paid.
Deposit. E-bike and e-scooter rentals must be credit card protected. We can do this either by card pre-authorization or by POS payment.
Pre-authorization of the card is not a payment but a retention of the funds until the rented equipment is returned. Card pre-authorization is not a charge, but a hold on funds until the bike is returned. At the end of the rental, card pre-authorization will be automatically canceled.
In the case of the warranty, the amount is transferred and the amount will be reimbursed in full if the returned equipment is in good working order and does not show signs of damage to the inspection of E-Bike Rental personnel. If the equipment is damaged or lost or stolen, a part or the total amount of the warranty coverage will be charged.
If the warranty/pre-authorization is not sufficient to cover the damages produced, the customer agrees to allow E-Bike Rental and its staff to withdraw from the card the amount necessary to cover these costs.
If you use the “pay now” payment method, when you make your reservation online, the deposit will be paid when you pick up the equipment, by credit card or cash.
Deposit amounts:
100 € per eqipment (or the equivalent in lei according to the exchange rates  offerd by the National Bank of Romania at the date of the rental) for electric kick scooters.
150 € per eqipment (or the equivalent in lei according to the exchange rates  offerd by the National Bank of Romania at the date of the rental) for electric touring bikes and electric mountain bikes.

Unacceptable behaviors. We have the right to refuse your rental if you or someone else in your group behaves unacceptably. For example, he/she uses the equipment for non-recreational purposes; he/she is under the influence of alcohol or drugs; he/she is not complying with traffic rules; or any other behavior considered unacceptable by E-Bike Rental personnel at its sole discretion.

9. Availability
If you want to rent our equipment and it appears unavailable on the date you wish to make the reservation, please contact us by phone or email to come up with a solution for you.
If you have booked a reservation on our web site, we will communicate the availability by email or phone.
If you have booked a reservation and it is unavailable at the time of booking for various reasons, for example unforeseen technical failures, we will contact you in advance and try to provide you with similar equipment.
This can happen extremely rarely, but if there is no other equipment available at the time of booking, we will, of course, reimburse you for the entire amount previously paid by you.
It may be very rare for the rental shop to dispose of the equipment required for renting, in which case we will reimburse the entire amount or we can offer you the alternative to obtain this equipment from another rental company.

10. Collecting the equipment. Documents required.
a) Prior to the signing of the Rental Agreement. At the pick-up point, you have the obligation to read the rental agreement, the rental conditions and to pay the applicable costs.
Also, inform yourself about: the charging methods for failing to return the equipment in time and the value of damaging the damage, or equipment shocks, theft, etc.
The amount of these taxes is determined by the cost of the parts, the repairs required and the market price of the equipment.
a) Documents required for the delivery of equipment
The following documents should be presented in original when you take over the equipment
• Valid identity card or passport
• Credit card valid and accepted by E-Bike Rental
b) Condition of the equipment. The customer has the obligation to check the status of the equipment, if you find any malfunctions, please mention them to E-Bike Rental personnel before signing the contract and starting the rental period.

11. Services offered. Rent period. Damage, theft.
a) As suppliers of rental services, we provide you as client our equipment and you as a client agree to rent our equipment hereinafter referred to as "Rental Equipment" through the service subject to the terms and conditions and in accordance with rental charges available and available on our website or at the rental office.

b) The rental period. You agree to pledge the equipment and pay the full amount of the services for the entire period included in the Rental Agreement. You understand and agree that the purpose of the service is to provide short-term access (between 1 and 7 days) to the equipment we rent. If you think you will be late, please let us know. If the equipment is not returned at the agreed date and time and we have not been notified, it means that you have violated the Rental Agreement. We allow a grace period of 30 minutes from the set time. Delays beyond the grace period will be charged to EUR 10 per hour or fraction of an hour. Any unpaid equipment rented within 5 hours of the time it was due to be returned and for which you did not notify the delay in advance will be deemed stolen or lost and the competent authorities will be notified. We will take steps to find and recover any equipment for which no delay has been reported, including reporting this to the police. Also, you will have to pay all the costs of the non-return, signing the Rental Agreement, you are giving us permission to do so.

c) Damage. Theft. Loss. Clients take full responsibility for caring for the rented equipment during the rental period.
In case of technical failure. In case of technical failures requiring immediate or rapid intervention, please contact us before making any repairs. For tire repair, you will receive a repair kit and a bicycle pump.
In the event of damage of rented equipment, you will immediately return any damaged equipment or we will come to take it, if it is not possible to return it in safe conditions. If the equipment is damaged, you will be charged the cost of repairing the damage at our discretion when the damage is reported to you or discovered by us. Amounts due for damaged rental equipment will be debited in cash or on the credit / debit card associated with your account, up to a maximum of € 4,000 per item or equivalent in local currency.
In case of theft / loss. If the equipment is stolen or lost during the rental period, you will contact us and then report the theft or lost equipment to the nearest police or competent authorities. You will reward us if the equipment is stolen or lost during the rental period. Amounts due to damaged, stolen or lost rental equipment will be debited in cash or on the credit / debit card associated with your account, up to a maximum of € 4,000 per item or equivalent in local currency

IMPORTANT! If any rental equipment is stolen, lost or damaged, you are required to pay all E-Bike Rental charges due for the theft, loss or damage to equipment / equipment at the market price of such equipment or service, whether your insurance travel or other type of insurance cover these costs or not.

d) By signing the Rental Agreement you authorize E-Bike Rental and it’s staff to debit your credit or debit card for all commissions and amounts due in respect of any damaged, stolen or lost equipment and we may, at our discretion, from your credit card to cover these amounts. If you dispute any tax in your account, then you must contact us within ten (10) days of receipt of your statement containing the tax in dispute.

12. Warning. Insurance. Assuming liability, risk and compensation
With respect to your rental and use of any services provided by E-Bike Rental, you are free and willing to declare that you are responsible to yourself and to your spouse, children, parents, guardians, heirs, relatives and any legal or personal representatives, executors, administrators, successors and empowered persons, or anyone else who may claim or sue you on your behalf, as follows:

a) Recognize and assume all risks of participating in this rental.
You know that the use of an electric bicycle / electric scooter is inherently dangerous and involves the potential for mild or serious bodily injuries, permanent disability, paralysis, death, and / or other material damage and loss.
You acknowledge and agree by signing the Rental Agreement that it is your responsibility to determine if you are sufficiently prepared and sufficiently healthy to rent and use safely the equipment you have rented that you choose voluntarily.
By signing the Rental Agreement you will assume liability and confirm that you have no physical or medical issue that would endanger you or others or interfere with your ability to safely use rented equipment . You also certify that you have not been advised by any healthcare professional to take part in cycling or any other activity related to the services provided by E-Bike Rental.
You understand and recognize that there may be road and vehicle traffic. You assume all other risks associated with the rental of equipment, including without limitation: Falls; dangers of collision with vehicles, pedestrians and fixed objects; the dangers generated by the surface type, the failure of designing the equipment and the inappropriate safety equipment; the dangers generated by vehicles, pedestrians and other cyclists; and weather conditions.
You also acknowledge that these risks include risks that could be the result of mistakes and / or the design of the equipment provided, or negligence, omissions and / or negligence of E-Bike Rental SRL (owner, team, etc.). You understand that you are using and using the services provided by E-Bike Rental at your own risk, that you are responsible for all risks incurred and that your rental is fully voluntary.

b) You have been advised to wear a helmet while using your equipment (bicycle, kick scooter). You understand and recognize the increased risk of bodily injury, permanent disability, paralysis and death due to lack of use of the helmet. You assume responsibility for any injury, loss or damage associated with your choice not to wear a helmet; in addition, since the helmet does not protect against all head injuries and protects against other injuries, you take responsibility for any injury, loss or damage associated with the rental, even if you choose to wear a helmet.

c) You also agree to adhere to "road rules": follow and obey all laws and regulations, observe traffic signs and stop signs, travel with traffic, clarify your intentions for cars and other road users, ride in a straight line and do not deflect, stay seated during travel (if applicable), rotate the signal and check before changing or changing the corridor.

d) You understand that although certain routes / routes have been suggested or recommended by E-Bike Rental, there are dangers that may arise along or near such routes that you have not been warned about and you agree that E-Bike Rent and its employees assume no responsibility for any warnings or other protection activities against any hazards you may encounter on these routes or elsewhere. The respective routes are not E-Bike Rental property, so E-Bike Rental does not deal with their arrangement or maintenance. You are responsible and voluntarily choose to follow or not the respective routes and thus undertake any incident or accident in which you are involved.

e) Voluntarily waive the right to charge and E-Bike Rental SRL, its representatives, subsidiaries (including but not limited to subsidiaries and affiliated companies), promoters, personnel, advertisers, owners, administrators, contractors, any other suppliers, equipment manufacturers, and any other person or entity involved in the rental (individually and collectively referred to as the "Exempted Parties") from any claims, debts of any kind, claims, damages including but not limited to (whether known , unknown, affirmed, unsatisfied, fixed, conditional or contingent) of any kind or nature (including, but not limited to, contract, damage, statutory or other) in the future, including court fees, lawyers' fees, and other expenses (individually and collectively referred to as "Complaints") that may arise or may arise including your death, personal injury, temporary or permanent disability, material damages and damages of any kind, theft of property and claims relating to first aid, medical care, medical treatment, or medical decisions, as well as any claims for medical or hospital expenses, even if such claims are due to acts of negligence, omission or inadvertence of the exempted parties and even if the exempted parties have been informed of the possibility of such complaints. Any such exemption is intended to be a complete and general exemption of all claims.

f) You also agree and agree not to sue any of the Excluded Parties for any of the above Complaints and to which you have renounced by signing the Rental Agreement. g) You agree to indemnify, hold harmless and indemnify the Exonerated Parties from any damages or costs incurred, Complaints made by you or third parties for debts incurred against the Excluded Party, including but not limited to costs, attorneys' fees, and costs arising from or resulting directly or indirectly, wholly or in part, from or in breach of any part of such waiver, breach or non-compliance with rental rules and / or actions or lack of actions that cause injury or damage to any other person or property.

h) Understand that rental of equipment does not provide insurance for damage or injuries sustained during the rental period. You agree to be responsible and to be responsible for all these and for all costs incurred as a result of your participation in the rental activity, including, without limitation, ambulance services, hospital stay, medical treatment. You agree to indemnify and hold Exonerated Parties against any liability for such costs.

i) You understand that we reserve the right, exclusively, to refuse to participate in the rental activities.

13. Privacy policy
By making the reservation, you agree and explicitly accept the processing of your personal data under the conditions imposed by law. More details on the processing of personal data can be found in the document called Privacy Policy on the site.
We will use your personal data for the following purposes:
- Booking process
- Performing identity and bank account verification
- To maintain and improve the administration and management of our services
- Marketing
- To defense of legitimate interests

14. Responsibility
E-Bike Rental, it’s site and S.C. E-Bike Rental S.R.L. will not be held responsible or warranted expressly or by default in any way for the operation of the site, the information or content of the site, the materials or products on the site. We disclaim liability for any situation that may occur due to software errors or technical failures that occur to the server.

For the avoidance of doubt, you do hereby acknowledge and agree that we and all other released parties (E-Bike Rental SRL, its representatives, staff, partners, etc.) are not responsible or liable for any claim that arises out of or relates to (a) any risk, danger, or hazard that might happen to you (b) your use of, or inability to use, any service, E-Bike Rental, or related information, (c) your breach of this agreement or your violation of any law, (d) any misconduct, or other action or inaction by you, or (e) your failure to wear a helmet while riding. You do hereby waive all claims with respect to any of the foregoing, including those based in contract, tort, statutory, or other grounds, even if we have been advised of the possibility of such claims. further, to the maximum extent permitted by law, in no event shall we or any released party be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from renting the use of, or inability to use, the services. moreover, if we, or any released party, are found to be liable for any claims on any basis, such liability shall be limited to the greater of (a) the total fees paid by you hereunder or (b) one hundred euro (€50).

15. Dispute resolution
By using E-Bike Rental services, you agree to resolve any claim you may have against E-BIKE RENTAL SRL, its representatives, subsidiaries and affiliates (including, without limitation) under this dispute settlement agreement.
You and E-Bike Rental agree that any litigation, claim or controversy arising out of or relating to (a) these Rental Conditions, the Rental Agreement, or the existence, breach, termination, execution, interpretation or validity thereof; or ) access or use of the Services at any time, either before or after the date you agreed to the terms and conditions of E-Bike Rental; be settled first and foremost amicably between you and E-BIKE RENTAL, and if this is not possible, the litigation will be settled at the competent courts in SIBIU, ROMANIA.
